Web Hosting’s Acceptable Use Policy (AUP)

This Use Policy governs the use of Win Authority LLC’s paid hosting services. Violation of this Acceptable Use Policy (“AUP”) may result in suspension or termination of your service. In the event of a dispute between you and Win Authority regarding the interpretation of this AUP, Win Authority’s interpretation, in its reasonable commercial judgment, shall govern.

Please read these Acceptable Use Policy carefully before using Win Authority’s hosting services that are available on the following websites: ‘https://www.winauthority.com’ and ‘https://app.winauthority.com’ (the “Service”) operated by Win Authority (“us”, “we”, or “our”).

Your use of the Service is conditioned on your acceptance of and compliance with this AUP. This AUP applies to all using our Service.

By accessing and using the Service you agree to be bound by this AUP. If you disagree with any part of the AUP then you may not access the Service

1. OFFENSIVE CONTENT

You may not publish or transmit via the Service any content that we reasonably believe:

    • Constitutes child pornography;
    • Constitutes pornography;
    • Is excessively violent incites violence, threatens violence, or contains harassing content or hate speech;
    • Is unfair or deceptive under the consumer protection laws of any jurisdiction, including chain letters and pyramid schemes;
    • Is defamatory or violates a person’s privacy;
    • Creates a risk to a person’s safety or health, creates a risk to public safety or health, compromises national security, or interferes with an investigation by law enforcement;
    • Improperly exposes trade secrets or other confidential or proprietary information of another person;
    • Is intended to assist others in defeating technical copyright protections;
    • Promotes illegal drugs, violates export control laws, relates to illegal gambling, or illegal arms trafficking;
    • Is otherwise illegal or solicits conduct that is illegal under laws applicable to you or us; or Is otherwise malicious, fraudulent, or may result in retaliation against Win Authority by offended viewers;
    • IRC scripts/bots, IRCD (irc servers), AutoSurf/PTC/PTS/PPC sites;
    • Broadcasting or streaming of live sporting events (UFC, NASCAR, FIFA, NFL, MLB, NBA, WWE, WWF, etc.) or television;
    • Setting up or using (via the Service) proxies, proxy scripts/anonymizers of any kind.

2. SECURITY

It is the responsibility of the client to take reasonable security precautions in protecting their login information to their services and the Win Authority’s client area. It is always the client’s responsibility to ensure the security of their website, we will not be responsible for compromised scripts or servers.

3. UNSOLICITED COMMERCIAL EMAIL OR SPAM

Our network is not designed to be used for mailing lists with over twenty (20) recipients and you may not send an email to more than twenty (20) recipients.

If you need to send an email to over twenty (20) recipients, please contact our Support Team for a list of other service providers that can assist with this task. Even if you send emails to fewer than twenty (20) recipients, we will consider your mail to be unsolicited, or SPAM, if it results in several complaints to us, disrupts our network, or subjects us to unfavorable action by other Internet providers.

Please review the “CAN-SPAM Act” and ensure that any commercial email you send complies with this Act. Email that is “CAN-SPAM compliant” may still otherwise be prohibited by this AUP.

If you believe one of our customers is engaged in spamming, please send an email containing all headers, and your contact information, to abuse[@]winauthority.com.

You may not publish, distribute, or otherwise copy in any manner any music, software, art, or other work protected by copyright law unless:

    • You have been expressly authorized by the owner of the copyright for work to copy the work in that manner;
    • You are otherwise permitted by established copyright law from your country, our country, and the United States to copy the work in that manner;

We will terminate the service of repeat copyright infringers.

5. COPYRIGHT INFRINGEMENT NOTICE DMCA (DIGITAL MILLENNIUM COPYRIGHT ACT)

If you believe your copyright is being infringed by a person using our service, please send your written notice of copyright infringement to abuse[@]winauthority.com

Your notice must include the following:

    • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
    • Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works at a single site are covered by a single notification, a representative list of such works at that site;
    • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material;
    • Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an e-mail address;
    • A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, the copyright owner’s agent, or the law;
    • A statement that the information in the notification is accurate, and under penalty of perjury that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

6. INTERNET ABUSE

You may not engage in illegal, abusive, or irresponsible behavior, including:

    • Unauthorized access to or use of data, systems, or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures (including those belonging to us and our customers) without express authorization of the owner of the system or network;
    • Monitoring data or traffic on any network or system without the authorization of the owner of the system or network;
    • Interference with service to any user, host, or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system, and broadcast attacks;
    • Use of an Internet account or computer without the owner’s authorization, including, but not limited to Internet scanning (tricking other people into releasing their passwords), password robbery, security hole scanning, and port scanning;
    • Forging of any TCP-IP packet header or any part of the header information in an e-mail or a newsgroup posting; or
    • Any conduct that is likely to result in retaliation against our network.
    • Use of our network in a way that unreasonably interferes with our customer’s use of the network.

7. DISCLAIMER

We are under no duty and do not by this AUP undertake a duty, to monitor or police our customers’ activities and disclaim any responsibility for any misuse of our network.
